Read The Law
What confusion over a Law-Breaker. That is Blagojevich! His temporary choice for Senator, Roland Burris must not be allowed to remain seated in the Senate. He is completely tainted, regardless of his abilities pro or con.
The U.S. Constitution (XVII Amendment) requires that a Governor call for special elections that are to be arranged by the state legislature to fill the vacancy. Blagojevich has broken the law in this manner, by not issuing writs of election (and why would he when he wanted to make money off an appointee). Also, according to this Amendment his appointment of Burris is only temporary until the special election is to be held!!(e.g., held along with the Illinois municipal-elections) However, (being only appointed not elected by the People) according to Article 1 Section 5 of the Constitution the Senate may expel a member with a two-thirds vote, being a judge of the qualifications of it's own members.
The real bone-head was the Judge that let Blagojevich out of jail after he had been arrested by the Feds, which allowed him to remain in Office and temporarily appoint Mr. Burris.
